Toms River Council Addresses Federal Subpoenas

GovWire

TOMS RIVER, NJ (GovWire) - During a recent council meeting, the topic of subpoenas served on current and former members of the Township council and land use boards was brought up. The subpoenas are part of two pending federal lawsuits filed in 2021, just before the settlement with the Department of Justice and changes to the zoning code.

Kathy Lazaro, a resident of Toms River, addressed the council and expressed her concern about the subpoenas. She asked if the council was going to fight back or just surrender and hand over money.

In response, the council's attorney stated that the subpoenas were expected and part of the discovery process. He called them a "fishing expedition" and a "litigation tactic" on the other side. He assured the council and the public that they would answer the subpoenas to the extent that they have to, and if there's reason to move to quash them, they will. The council meeting continued with other topics, but the subpoenas remained a point of concern for some residents. As the lawsuits continue, the council and the public will be keeping a close eye on the developments.
